HugTone Terms of Service

These are the terms of using HugTone. Plain English, no legalese traps.
1. What HugTone Is
HugTone is a compatibility-based social app that uses AI to analyze personality, values, and physical type preferences, then alerts users via audio tones when a compatible person is physically nearby. The goal is to facilitate real-world, organic encounters between compatible people.
2. Eligibility
To use HugTone, you must:
- Be at least 18 years old
- Provide a valid phone number for verification
- Not have been previously banned from HugTone
- Agree to these terms
3. Your Account
- You may only have one account. Creating multiple accounts will result in a permanent ban.
- You are responsible for everything that happens under your account.
- You must provide truthful information during onboarding and profile setup. Deliberately misrepresenting your identity, appearance, age, or other profile information may result in account suspension or termination.
- Identity verification via government ID is required. Attempting to verify with a fraudulent or altered document will result in a permanent ban.
4. What You Pay
HugTone uses the following pricing:
- Onboarding fee: $1.99 (one-time, covers AI personality profiling)
- Subscription: $5.99/year (starts after your first free month)
- Re-analyze your look: $0.99 per analysis
- Re-analyze your type: $0.99 per analysis
- Ping credit (message request): $5.00 per credit, used only if the recipient accepts
- Profile reset: $4.99 per reset
- Soul Link credit: $50.00 per credit, used only if your Soul Link reciprocates
All payments are processed through Apple's App Store or Google Play. Refund policies are governed by the respective platform's policies. Ping and Soul Link credits work on a hold system — your credit is held when you send or unlock, consumed only when the other person accepts or reciprocates. If they decline or don't respond within the expiry period (7 days for pings, 30 days for Soul Link), your credit is returned automatically.5. How You Must Behave
By using HugTone, you agree to:
Do:
- Treat other users with respect and dignity
- Meet in public places when meeting a match for the first time
- Use the block and report features if someone makes you uncomfortable
- Be honest in your profile and conversations
Do Not:
- Harass, stalk, threaten, or intimidate any user, whether through the app or in person
- Send abusive, hateful, or threatening messages via pings or conversations
- Attempt to circumvent the app's matching, verification, or safety systems
- Use HugTone to promote or sell products, services, or solicit money
- Impersonate another person or create a fake identity
- Collect or scrape other users' data
- Reverse-engineer the app, its algorithms, or its compatibility scoring
- Use the app while under 18 or facilitate use by minors
- Share another user's information (name, photo, compatibility data) outside the app without their consent
Violation of these rules may result in immediate account suspension or permanent ban, at our sole discretion. We reserve the right to ban users without refund for serious violations.HugTone has zero tolerance for objectionable content or abusive users. Any user who posts objectionable content (including but not limited to harassment, hate speech, sexual content involving minors, threats, or content depicting violence) will have their content removed and their account permanently terminated, without refund. Reports of objectionable content are reviewed and acted on within 24 hours.
6. Compatibility Scores & Matching
HugTone's compatibility scores are generated by artificial intelligence and statistical modeling. They are tools to facilitate introductions, not guarantees of relationship success.
- A high compatibility score means our AI detected meaningful alignment across multiple personality dimensions. It does not mean two people will like each other, fall in love, or have a successful relationship.
- A low score does not mean two people are incompatible in real life.
- Compatibility scores should be treated as one signal among many, not as definitive relationship advice.
- HugTone does not provide professional matchmaking, therapy, counseling, or psychological services.
We make no promises, representations, or guarantees about the quality, accuracy, or outcome of any match.7. Physical Proximity & Real-World Encounters
HugTone facilitates awareness of nearby compatible users. When you and a compatible user are in physical proximity, both of your devices may play an audio tone.
Important:
- HugTone does not arrange, supervise, or monitor real-world encounters. What happens after the tone plays is between two adults.
- HugTone is not responsible for the actions of its users, whether in the app or in person. We provide tools (blocking, reporting, safety aliases, trusted witness features), but we cannot control human behavior.
- Meeting someone in person involves inherent risk. We strongly encourage meeting in public places, telling a friend where you're going, and using HugTone's built-in safety features.
- HugTone does not guarantee the identity, character, or intentions of any user. While we verify identity via government ID and AI photo analysis, no verification system is perfect.
8. Safety Features
HugTone provides several safety features:
- Block & Report — block any user at any time; report users for review
- Safety Aliases — option to display a chosen name instead of your real name during proximity encounters
- Go Invisible — disable proximity detection at any time
These features are tools, not guarantees of safety. You are ultimately responsible for your own safety when meeting people in person.9. Content You Provide
By uploading photos or providing text content to HugTone, you grant us a limited license to:
- Store and process your content for the purpose of operating the service
- Analyze your content using AI for compatibility matching and verification
- Display your profile photo and display name to matches (after proximity encounters)
You retain ownership of your content. We will never use your content for advertising, marketing, or any purpose other than operating the HugTone service for your benefit. This license terminates immediately when you delete your account.10. What We're Responsible For (and What We're Not)
We are responsible for:
- Operating the app in good faith
- Protecting your data as described in our Privacy Policy
- Responding to reports and safety concerns
- Providing the features described in the app
- Being transparent about how the app works
We are NOT responsible for:
- The behavior of other users, online or in person
- The outcome of any match or encounter
- Emotional distress resulting from compatibility scores, matches, or encounters
- Any harm that occurs during a real-world meetup
- Interruptions in service, bugs, or technical failures
- The accuracy of AI-generated compatibility assessments
- Third-party services (Apple, Google, telecommunications providers)
HugTone is provided "as is." We do our best to make it work well, but we cannot guarantee uninterrupted, error-free service.11. Limitation of Liability
To the maximum extent permitted by law, HugTone's total liability to you for any claim arising from your use of the app is limited to the amount you have paid to HugTone in the 12 months preceding the claim. In no event will HugTone be liable for indirect, incidental, consequential, special, or punitive damages.
12. Dispute Resolution
If you have a dispute with HugTone:
1. Contact us first at hugtonesupport@gmail.com. Most issues can be resolved directly.
2. If we can't resolve it, disputes will be settled by binding arbitration under the rules of the American Arbitration Association, conducted in the United States.
3. You agree to resolve disputes individually. Class action lawsuits and class arbitrations are waived to the extent permitted by law.
4. Nothing in this section prevents you from filing a complaint with a government agency (FTC, state attorney general, etc.).
13. Account Termination
- You can delete your account at any time. All your data will be permanently deleted immediately.
- We can suspend or terminate your account if you violate these terms, with or without notice depending on the severity of the violation.
- Banned users may not create new accounts. Bans are enforced via ID document hash matching — we don't store your document, but we do store a hash that prevents re-registration with the same ID.
14. Changes to These Terms
We may update these terms. If we make material changes, we will notify you via the app and email at least 30 days before the changes take effect. Your continued use of HugTone after changes take effect constitutes acceptance of the updated terms. If you disagree with a change, you may delete your account.
The commitments in our Privacy Policy Section 4 ("What We Will Never Do") are permanent and apply regardless of any changes to these Terms of Service.
15. Miscellaneous
- These terms are governed by the laws of the State of California.
- If any provision of these terms is found unenforceable, the remaining provisions remain in effect.
- Our failure to enforce a provision is not a waiver of our right to enforce it later.
- These terms, together with the Privacy Policy, constitute the entire agreement between you and HugTone.
